Do businesses have to close on a bank holiday? ›

Businesses are not required by law to close on bank holidays. In sectors that are unable to close or allow workers to have time off during a bank holiday, such as the NHS, retail, or hospitality and leisure, you should consider compensating your workers.

Is Saturday and Sunday include in annual leave? ›

Saturdays and Sundays shall not be counted as days of annual leave except in cases covered by Section 9, third paragraph.

Should the employment period be greater than one year, an employee is entitled to 30 days of paid leave annually as per UAE Labour Laws. This annual leave may include public holidays and/or weekends that fall within the aforementioned 30 days, however this policy is at a company's discretion.

There is sometimes confusion over the interpretation of the 21 days' continuous leave. What this means is that an employee has 15 working days' leave per year. Therefore, it means that weekends are included in the 21 days' leave.

If you have been asked to work this May Bank Holiday, you may be entitled to a day off in lieu from your employer. You can work this out by the number of days you work a week x 5.6. For example, if you work 3 days a week, you're entitled to 16.8 days' paid holiday (3 x 5.6) a year. If your employer gives full-time employees more than the statutory annual leave (for example, 6 weeks), then part-time employees must get the same.

If you work part-time

If your work shuts on bank holidays and you normally work on those days, you'll have to take them as paid holiday. Because you work part-time, you'll be entitled to fewer statutory holiday days each year than if you were full-time.

The basic way to work out how many days holiday an employee is entitled to is to multiply the number of days a week they work by 5.6. That gives someone working a five-day week the 28 days we've already mentioned. Someone who is part-time and only works three days a week would be entitled to 3 x 5.6 = 16.8 days.

There's no legal entitlement to bank holidays off

As an employer, it's entirely up to you whether you choose to offer bank holidays as paid leave.

No statutory right to extra pay for working on bank holidays. There is no statutory right to extra pay, for example time and a half or double time, when an employee works on a bank holiday. Any right to extra pay depends on the terms of the employee's contract of employment.
